Construction disputes in Vietnam frequently involve international standard-form contracts, most notably those developed by FIDIC which are widely used in ODA-funded infrastructure, energy, and large-scale development projects. These contracts incorporate sophisticated mechanisms drawn from both common law and civil law traditions. When applied in Vietnam, however, concepts such as delay and liquidated damages, multi-tier dispute resolution clauses, force majeure, fundamental changes of circumstances, and non-contractual liabilities may raise difficult questions of interpretation and enforceability under Vietnamese law.
Against the backdrop of the recently adopted Construction Law 2025 of Vietnam, this session will bring together seasoned construction disputes practitioners from multiple jurisdictions to explore how these key contractual concepts are understood and applied internationally, and to consider how they may operate in the context of construction disputes involving Vietnamese projects.
