Sanctions have significantly affected arbitral proceedings. As a part of Nordic Arbitration Day last week, Partner, Haakon Orgland Bingen moderated a panel, together with Caroline Gulliksson Dock, Lisa Berger, Joel Kujala and Fredrik Lindmark, exploring the topic of 𝘚𝘢𝘯𝘤𝘵𝘪𝘰𝘯𝘴 𝘪𝘯 𝘈𝘳𝘣𝘪𝘵𝘳𝘢𝘵𝘪𝘰𝘯: 𝘗𝘳𝘢𝘤𝘵𝘪𝘤𝘢𝘭 𝘓𝘦𝘴𝘴𝘰𝘯𝘴, 𝘊𝘰𝘮𝘮𝘰𝘯 𝘗𝘪𝘵𝘧𝘢𝘭𝘭𝘴, 𝘢𝘯𝘥 𝘵𝘩𝘦 𝘌𝘭𝘶𝘴𝘪𝘷𝘦 𝘓𝘢𝘸.

The discussion focused on:

  • the recent opinions by the Advocate Generals Biondi and Szpunar on the arbitrability of disputes with a sanctions relation, and whether an award can be enforced if it is unclear if the award creditor is controlled by sanctioned rebels;
  • the 20th sanctions package by the EU and the Russian Lugovoy Act; and
  • a potential divergence between US and EU sanction regimes in a world where major geopolitical shifts can take place overnight.

In addition to the deep dive into recent legal developments, they also covered practical lessons and common pitfalls.
